Who is at Fault?
Here is the situation: A person stole a car, got caught and was arrested. After his arraignment and before his actual trial he was released after a family member used a Sacramento bail bonds agent to secure his release. As soon as he was released he violently stole (carjacked) another vehicle and shot the victim. The victim died at the scene, and the carjacker got away. The carjacker has since eluded capture and it is assumed he has left the country.
So who is at fault in this situation? The California bail bonds agent could be seen as being at fault. After all, without the bail bond agent’s actions, the carjacker would have still been in jail when it occurred. Or could it be the judge’s fault? After all, it was the judge who set bail. The judge did have the option of making bail not even an option. I suppose we could even blame the prosecutor or the family member who paid to bail out the carjacker.
Maybe the blame can not be put on just one person. Perhaps the system is at fault. The American judicial system is very good, but no judicial system can ever be perfect. Regardless of whether or not someone is to blame, it is an unfortunate situation.
